Age Discrimination Under Federal Law | ADEA
Under the Federal Age Discrimination in Employment Act (ADEA), employers with at least 20 employees are prohibited from discriminating against workers aged 40 or older. It specifically makes it unlawful for an employer to discharge any individual or otherwise to "discriminate against any individual in respect to his or her compensation, terms, conditions or privileges of employment".

California law also prohibits age discrimination. The Fair Employment and Housing Act (FEHA) protects workers aged 40 or older from discrimination in the workplace, or in hiring practices. While the law is similar to the ADEA, it has even wider coverage, applying even to smaller employers, which the state defines as "any employer with at least five employees".
